Background

Refugio Macias forced his attentions upon Paula Medina, a niece of Pedro Ornelas, deceased, prior to the homicide. Paula Medina had a sweetheart relationship with Antonio Lerma. Paula Medina was connected by family to Pedro Ornelas, deceased, and Julian De Luna, deceased, both of whom resided at the house.

The offence

On the morning of the 18th of January, 1929, a homicide occurred at Morenci, Arizona. On the evening of the 17th of January, 1929, Refugio Macias followed Paula Medina home. At about 5:30 P.M., Refugio Macias was told by a sister of Paula Medina not to bother her any more. At approximately 7:30, Refugio Macias shot and wounded Antonio Lerma and shot at Cepriana Delgado, described as a brother-in-law. Shortly thereafter, Refugio Macias was seen at the home of Cepriana Delgado with a pistol in his hand trying to gain admission to the house. He was recognized by his voice by the people within the house. Refugio Macias returned to the house at about 1:00 A.M. and tried to gain admission by forcing the door and windows. Pedro Ornelas, deceased, and Julian De Luna, deceased, both uncles of Paula Medina, dressed and came out to find out who was making the disturbance. Whereupon Pedro Ornelas and Julian De Luna were both shot down by Refugio Macias. The testimony showed that there was no evidence of a fight. The testimony also showed that neither Pedro Ornelas nor Julian De Luna was armed at the time.

Investigation

The defendant planned his flight prior to the homicide by packing his suitcase and leaving same with a friend with instructions to forward same.

Arrest

Refugio Macias was apprehended by the Sheriff’s office at about 3:00 A.M. on the morning of the 18th of January, 1929, between Morenci and Clifton. At the time of his arrest he still had the pistol with which he shot Pedro Ornelas and Julian De Luna.

Outcome

Refugio Macias was executed by hanging on March 7, 1930.
