Brewer had prior criminal history and had served prison sentences in Texas. During the punishment phase of his capital murder trial, jurors learned that he had previously been convicted of burglary of a habitation in 1986 and was sentenced to 10 years in prison, probated for 7 years. He was again convicted of burglary of a habitation in 1987 and sentenced to 10 years in prison, probated for 10 years. His probation was revoked in 1987 and he was sentenced to 7 years in prison.

In 1988, Brewer was released on parole. In 1989, he was convicted of possession of a controlled substance cocaine. His parole was revoked and he was sentenced to 15 years in prison. In 1991, Brewer was released on parole again. In 1993, his parole was revoked for failure to report to his parole officer, and he was returned to prison to serve his 15-year sentence. In 1997, Brewer was released again on parole and remained on parole until he was arrested for the murder of James Byrd Jr. in 1998.
