Background

Huang Wenyi was a mentally ill man who was sentenced to death with a two-year stay on July 11, 2007. The Higher People's Court in south China's Guangdong Province upheld his suspended death sentence on November 21, 2007 after reviewing case files and judiciary appraisals of the convict.

Before the murders, Huang feared he would be implicated after his relatives had been arrested for economic crimes. He also feared that he would be murdered by his wife or others, according to court files.

Judicial appraisals indicated Huang was mentally ill at the time of the crimes, and under Chinese law, leniency could be considered for mentally ill defendants.

The offence

Huang murdered five family members and an employee with a hammer.

At around 2:00 a.m. on Dec. 28, 2006, Huang murdered his wife, Cai Qiuyi; his seven-year-old son; his mother-in-law; his sister-in-law; and a woman who worked in the pharmacy he owned with his wife. The killings occurred in his home in Nanhai District, Foshan City, after Huang quarreled with his wife.

One hour later, Huang lured another sister-in-law into a garden at Foshan No. 1 People's Hospital, where he killed her with the same hammer.

Investigation / Arrest

Huang was arrested four days after the murders on Jan. 1 at a hotel in Guangzhou, capital of Guangdong.

Trial

Huang was tried in an intermediate court in Foshan City, Guangdong in April. The intermediate court gave him a death sentence with a two-year stay on July 11.

Sentencing / Appeals

The Higher People's Court upheld the suspended death sentence on Wednesday, Nov. 21, 2007, after reviewing case files and judiciary appraisals.

The sentence would be further reviewed by the Supreme People's Court (SPC), which got the right to review death sentences from Jan. 1 this year.
